Privacy Policy

Kemest ("we", "our", "us") is committed to protecting your personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA). This policy explains what information we collect, how we use it, and your rights as a data subject.

1. Information We Collect

We collect personal information when you register or use the Kemest app, including:

  • Account data: name, email address, phone number, and profile photo.
  • Seller data: business name, banking details, and product listings.
  • Transaction data: order history, delivery addresses, and payment confirmations.
  • Device data: device type, OS version, push notification token, and app usage analytics.
  • Location data: delivery address you provide (we do not track your GPS location continuously).

2. How We Use Your Information

We use your information to:

  • Create and manage your account.
  • Process orders and payments.
  • Send order status notifications and app updates.
  • Improve the Platform through analytics.
  • Resolve disputes and enforce our Terms and Conditions.
  • Comply with legal obligations under South African law.

3. Sharing Your Information

We do not sell your personal information. We share it only with:

  • Sellers — to fulfil your order (name, delivery address, order details).
  • Payment processors — to complete transactions securely.
  • Firebase (Google) — for hosting, authentication, and database services.
  • Law enforcement — when required by applicable South African law.

4. Data Storage and Security

Your data is stored on Firebase infrastructure, which uses industry-standard encryption in transit and at rest. We apply appropriate technical and organisational measures to protect your information. However, no system is completely secure and we cannot guarantee absolute security.

Some of our service providers, including Firebase/Google Cloud, may process or store your information on servers located outside South Africa. Where this occurs, we take reasonable steps to ensure the recipient is subject to data protection obligations that provide an adequate level of protection substantially similar to POPIA, as required by section 72 of POPIA.

5. Your Rights (POPIA)

Under POPIA you have the right to:

  • Access the personal information we hold about you.
  • Request correction of inaccurate information.
  • Request deletion of your data (subject to legal retention obligations).
  • Object to the processing of your information.
  • Lodge a complaint with the Information Regulator of South Africa.

To exercise any of these rights, contact our Information Officer at support@kemest.co.za. If you are not satisfied with our response, you may lodge a complaint with the Information Regulator of South Africa:

6. Account Deletion

You can delete your account at any time directly from the Kemest app:

  1. Open the Kemest app and sign in.
  2. Tap Account in the bottom navigation.
  3. Scroll down and tap Delete Account.
  4. Confirm when prompted.

Upon deletion, your profile and personal information are permanently removed. Order records and transaction data may be retained for up to 5 years to comply with legal and financial obligations. Seller payout records are retained as required by South African tax law.

If you cannot access the app, email support@kemest.co.za with the subject line "Account Deletion Request".

7. Cookies and Analytics

The Kemest app uses Firebase Analytics to understand how users interact with the app. This data is aggregated and anonymised where possible. Our website (kemest.co.za) may use cookies to maintain session state. You can disable cookies in your browser settings.

8. Children's Privacy

The Kemest Platform is not intended for children under 18. We do not knowingly collect personal information from minors. If you believe a minor has registered, contact us immediately and we will delete the account.

9. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes via the app or email. Your continued use of the Platform after changes take effect constitutes acceptance of the updated policy.

10. Information Officer

In accordance with section 55 of POPIA, Kemest (Pty) Ltd has designated an Information Officer responsible for compliance with POPIA and for handling data subject requests and complaints. The Information Officer can be reached at support@kemest.co.za.
