Terms of Service

1. About Kemest

Kemest is a wellness marketplace that connects buyers with sellers of wellness products and services. We provide the technology platform; we are not a seller ourselves and do not take ownership of any products listed on the Platform.

2. Eligibility

To use Kemest you must:

• Be at least 18 years old, or have parental/guardian consent.
• Provide accurate and complete registration information.
• Not be prohibited from using the Platform under applicable law.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@kemest.co.za if you suspect unauthorised access. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Sellers

If you register as a seller on Kemest, you agree to:

• Provide accurate descriptions, pricing, and images for all listed products or services.
• Only list wellness products and services that are legal and safe for consumers.
• Fulfil orders promptly and as described.
• Comply with all applicable South African consumer protection, tax, and business laws.
• Not engage in fraudulent, deceptive, or misleading listings.

Kemest reserves the right to remove any listing and suspend any seller account that violates these requirements.

Seller agreement — payouts & disputes

• Payouts may be delayed due to payment processing times, identity verification checks, or active disputes on your account.
• Orders identified as fraudulent may be reversed and the associated payout withheld, adjusted, or clawed back at Kemest's discretion.
• Sellers are solely responsible for any losses resulting from fake, undelivered, or misrepresented shipments; Kemest will not absorb those losses on the seller's behalf.
• Kemest may place a hold on funds related to a transaction during an active dispute and will release them only once the dispute is resolved.

Product liability & indemnification

• Sellers are solely responsible for the quality, safety, legality, and regulatory compliance (including SAHPRA compliance, where applicable) of every product or service they list.
• Kemest does not manufacture, inspect, test, or endorse any product listed on the Platform, and assumes no liability for any claim arising from a product's quality, safety, efficacy, or legality, including personal injury, illness, or property damage allegedly caused by a product.
• Sellers agree to indemnify, defend, and hold harmless Kemest, its officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to: (a) products or services they list or sell on the Platform, including product liability, personal injury, or property damage claims; (b) breach of these Terms; or (c) violation of any applicable law or regulation.

5. Buyers

As a buyer you agree to:

• Provide accurate delivery and payment information.
• Pay for orders in full at the time of purchase.
• Use purchased products or services only for their intended, lawful purpose.
• Resolve disputes in good faith through our in-app dispute resolution process before pursuing other remedies.

Buyer policies — chargebacks & verification

• Fraudulent chargebacks — initiating a chargeback for an order that was legitimately fulfilled — are strictly prohibited and may result in immediate account suspension and recovery of funds.
• Delivery evidence, including courier tracking data, proof-of-delivery scans, and dispatch confirmations, is used by Kemest when assessing and resolving disputes.
• Identity verification may be required for high-value purchases or accounts flagged for unusual activity before an order is processed or a payout is released.

6. Payments

Payments are processed through our third-party payment provider. By completing a purchase you also agree to that provider's terms. Kemest does not store your full card details. All prices are displayed in South African Rand (ZAR) and include VAT where applicable. Refunds are subject to the individual seller's refund policy and our Refund Guidelines.

7. Prohibited Activities

You may not use the Platform to:

• Post false, misleading, or fraudulent content.
• Sell counterfeit, unsafe, or illegal products.
• Harass, abuse, or harm other users.
• Circumvent any security or authentication measures.
• Scrape, copy, or redistribute Platform content without written permission.
• Use the Platform for any purpose other than legitimate wellness commerce.

8. Intellectual Property

All content on the Kemest Platform — including logos, design, text, and software — is owned by or licensed to Kemest and protected by applicable intellectual property laws. You may not reproduce or distribute any part of the Platform without our prior written consent. Sellers retain ownership of their own product images and descriptions but grant Kemest a non-exclusive licence to display that content on the Platform.

9. Privacy

Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information in accordance with the Protection of Personal Information Act (POPIA). By using the Platform you consent to those practices.

10. Limitation of Liability

Kemest provides the Platform on an "as is" basis. To the maximum extent permitted by law, Kemest is not liable for any indirect, incidental, or consequential damages arising from your use of the Platform, including disputes between buyers and sellers. Our total liability to you for any claim will not exceed the amount you paid for the transaction giving rise to the claim.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via the app or email. Continued use of the Platform after changes take effect constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms will be subject to the jurisdiction of the South African courts.

13. Health & Regulatory Disclaimer

This complementary medicine has not been evaluated by the South African Health Products Regulatory Authority (SAHPRA) for its quality, safety or intended use. This medicine is not intended to diagnose, treat, cure or prevent any disease.

Always consult a registered healthcare professional before using traditional and herbal remedies. These products are complementary remedies and do not replace professional medical advice or prescribed treatments.
